War Dept escalates review into Mark Kelly to ‘official Command Investigation’

A Department of War preliminary inquiry into Retired US Navy Captain and current US Senator Mark Kelly has been escalated to an official Command Investigation by the department’s Office of the General Counsel. This comes after Kelly’s appearance in a video alongside other Democrat lawmakers calling for active duty troops to “refuse illegal orders” came under scrutiny.

“The Office of the Secretary of War, in conjunction with the Department of War’s Office of the General Counsel, is escalating the preliminary review of Captain Mark Kelly, USN (Ret.), to an official Command Investigation,” a Department of War official told independent journalist Breanna Morello. “Retired Captain Kelly is currently under investigation for serious allegations of misconduct. Further official comments will be limited to preserve the integrity of the proceedings.”

Earlier in December, the Department of War said that “all options are on the table” in terms of the investigation into Kelly regarding the video, including a court-martial. “All options are on the table at this moment in time, and we look forward to getting the Secretary of the Navy’s review. And the Secretary of War has been very clear in his statements as well that he takes this extremely seriously, and it is unacceptable,” Department of War Secretary Kingsley Wilson said at a press conference. 

Kelly appeared alongside fellow Senator Elissa Slotkin, as well as Representatives Chris Deluzio, Maggie Goodlander, Chrissy Houlahan, and Jason Crow in the November video. All were members of the armed services or the intelligence community.

As the video flipped through various speakers, the lawmakers said, “This administration is pitting our uniformed military and intelligence community professionals against American citizens. Like us, you all swore an oath to protect and defend this Constitution. Right now, the threats to our Constitution aren’t just coming from abroad, but from right here at home. Our laws are clear: you can refuse illegal orders.”

“You must refuse illegal orders. No one has to carry out orders that violate the law or our Constitution. We know this is hard, and that it’s a difficult time to be a public servant. But whether you’re serving in the CIA, the Army, our Navy, the Air Force, your vigilance is critical, and know that we have your back.”
