A 26-year-old “trans nonbinary” individual charged with attempting to murder a Border Patrol agent in New Hampshire has been released from federal custody on a medical furlough to receive treatment for a traumatic brain injury.
“Blu Zeke Daly,” also known as “Cullan Zeke Daly,” was indicted in May on federal charges of attempted murder of a federal officer and assaulting a federal officer with a dangerous or deadly weapon.
The charges stem from a February incident in Stewartstown, New Hampshire, near the Canadian border.
According to a Department of Justice press release, a Border Patrol agent initiated a traffic stop on Daly.
After Daly provided a driver’s license and then drove away, the agent followed.
When Daly reached the locked Pittsburgh Port of Entry, the agent activated emergency lights and approached the vehicle on foot.
Daly allegedly turned the car around and fired a handgun at the agent through the window.
The agent returned fire, striking Daly in the head.
Daly’s vehicle then crashed into a snowbank.
Daly was seriously wounded and has been receiving medical care since the shooting.
In May, Daly pleaded not guilty to the charges from a hospital bed.
U.S. Magistrate Judge Andrew Johnston approved Daly’s release on medical furlough after a multi-day detention hearing, according to a report from the Post Millennial.
The judge cited Daly’s “evolving medical condition” and the need for treatment at a rehabilitation hospital that does not accept patients in federal custody.
Under the terms of the release, Daly’s mother, stepfather, and paternal grandparents are permitted to visit.
The court also granted a nine-month delay in the trial schedule, noting ongoing issues related to Daly’s medical condition and custodial status.
In the detention hearing, Judge Johnston acknowledged that “the circumstances raise serious questions about the defendant’s willingness/ability to comply with orders by law enforcement,” but ultimately determined that the medical needs outweighed the factors favoring continued detention.
Daly had a Massachusetts driver’s license listing a male designation, but later obtained a New Hampshire license with a female designation.
Federal prosecutors have stated they are investigating possible connections between this shooting and the January 2025 killing of Border Patrol Agent David Maland in Vermont, which involved individuals linked to a group known as the “Zizians.”
However, officials have said they do not yet have evidence tying Daly to that group.
Daly faces up to 20 years in prison and fines of up to $250,000 on each count if convicted.
